OUR PRIVACY POLICY

The Motherhood, Inc. (“The Motherhood”) knows that you care about how your Personal Information is used and shared, and we take your privacy concerns seriously. By visiting The Motherhood website located at www.TheMotherhood.com (the “Site”), you (as a “Member”, one who completes our registration and login) are accepting the terms of this Privacy Policy.

1. Scope. This Privacy Policy covers The Motherhood's treatment of “Personal Information” that it gathers when Members are using services we offer through our Site. “Personal Information” is any type of information that can be used to identify you.

2. Types of Personal Information Collected. The Motherhood collects the following types of Personal Information from our Members:

a. Information You Provide to Us. The Motherhood collects and stores any information you enter on the Site, including but not limited to information you enter upon registration (such as name and email address) or information you provide through participation in our community (i.e., via a profile update, or contribution to a Live Talk or Circle). Some of your information may be demographic and/or uniquely identifying. You may also provide Personal Information to us via some other means of communication (i.e., telephone, video, email or written letter, etc.). During your use of the Site, we may also request and/or you may provide additional information.

b. Automatic Information. At the same time, The Motherhood receives and stores certain types of information automatically whenever you interact with us, such as certain “traffic data” on our server logs from your browser, including your IP address as well as The Motherhood “Cookie” information. Our server also automatically collects usage information, such as the number and frequency of Members to our Site and to the various component pages of our Site. This automatic data is only used in the aggregate.

3. Sharing of Information. We are an online community, aiming to provide a dynamic forum for mothers. Information disclosed by our Members is an integral part of our Site. We do not sell your Personal Information to anyone. We do share your Personal Information as described below:

a. Sponsors. The Motherhood may provide services in conjunction with certain business sponsors (“Sponsors”). We may share Member information with Sponsors related to such services. We require our Sponsors to provide the same level of privacy that we do and they do not have the right to share or use Personal Information for any purpose other than for an authorized transaction.

b. Agents. The Motherhood shares your Personal Information from time to time with people whom we employ to perform tasks on our behalf.

c. Public Information You Post. When you post content to the Site, your Motherhood Member name is visible to other Members as well as to guests to the Site. If you post Personal Information online that is accessible to the public, in return, you may receive unsolicited messages from both Members and guests to the Site. The Motherhood is not responsible for any matters arising from the voluntary disclosure of any information on the Site.

d. Business Transfers. In the future, the Motherhood may choose to sell all or substantially all of its assets to another entity. We may share your information in such event, since Member information is a business asset and would likely be transferred with the business. The Motherhood will notify you of such a transfer.

e. Protection of the Motherhood and Third Parties. The Motherhood will disclose your Personal Information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on The Motherhood; (b) protect and defend the rights or property of The Motherhood; and/or, (c) act under exigent circumstances to protect the personal safety of Members of The Motherhood, or the public.

f. Unlawful Activity. The Motherhood may disclose Personal Information to third parties in order to enforce or apply our Terms of Use Agreement (incorporated herein in its entirety), as The Motherhood, in its sole discretion, believes necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity.

g. With Your Consent. Except as otherwise provided herein, The Motherhood may seek your affirmative consent to share your Personal Information with third parties.

4. Purpose of Gathering Personal Information. Our primary goal in collecting Personal Information is to provide you with a friendly, customized, and efficient experience in our online community.

a. The Personal Information you provide may be used for responding to your requests for certain services, customizing the content and advertising you see, and communicating with you about upcoming events, campaigns, new Circles, or Live Talks.

b. One of the primary purposes of cookies is to provide a convenience feature to save Members time. A cookie tells a server that you have returned to a specific page. For example, if you personalize The Motherhood pages, or register with The Motherhood site or services, a cookie helps The Motherhood recall your specific information on subsequent visits. When you return to the same Site or page, the information you previously provided can be retrieved. Most web browsers automatically accept cookies. As discussed herein, you have the ability to accept or decline cookies. The Motherhood does not combine information collected through cookies with other Personal Information to tell us who you are or what your Member name or e-mail address is.

c. We use the server's traffic data to help diagnose problems with its server, analyze trends and administer the Site.

d. We may also provide to our Sponsors aggregated statistical information (i.e., demographic information) and information regarding how our Members, collectively, use our Site.

e. Some of our Sponsors, advertisers and/or traffic measurement services may set and access their own cookies on your computer. We have no access to, or control over these cookies. If information is collected through a cookie we have placed, this Privacy Policy will apply. However, if information is collected through a cookie placed by a third party, the privacy policy of the entity that placed the cookie will apply.

5. Opt-out Options.

a. Email Communications. The Motherhood from time to time may send emails with news, event notifications, products offers and/or promotions to your The Motherhood inbox on behalf of The Motherhood or its Sponsors. The Motherhood may receive a confirmation when you open such an e-mail. We will not give Sponsors your name and address. If you do not want to receive e-mail from us, you may opt-out of any and all communications by contacting us at contact@TheMotherhood.com.

b. Cookies. We recommend leaving cookies active in order to take full advantage of the site's full range of offerings. If you choose to disable cookies, The Motherhood might not function properly for you, as The Motherhood relies on cookies like most other sites do.

c. Requests for Non-Disclosure. If any time, you wish to opt out of the disclosure of certain Personal Information, please email your request to contact@TheMotherhood.com.

6. Security of Information.

a. Password Protection. Your Motherhood account information is protected by a password for your privacy and security. You need to employ preventative measures against unauthorized access to your password and your primary computer. Remember to sign off once you have finished using any shared computer.

b. Security Measures. The security of your Personal Information is important to us. The Motherhood follows generally accepted industry standards to protect the Personal Information submitted to The Motherhood, both during transmission and once it is received. Namely, we use industry standard encryption when transferring and receiving data, firewalls, electronic, procedural measures, and physical (on site) measures. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while The Motherhood strives to use commercially acceptable means to protect your Personal Information, The Motherhood cannot guarantee its absolute security. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of Member information at any time. c. Need to Know Basis. As discussed above, certain employees or other agents of The Motherhood may need Members' Personal Information to perform a specific job (for example, a Member customer service representative). Such employees or other agents are granted access to such information only on a need-to-know basis. All of our employees or other agents are subject to a Confidentiality and Non-Disclosure Agreement and are kept well-informed regarding our privacy and security practices.

7. Ability to Access, Add, Update, Retract, or Delete Information; Storage Policy

a. You are able to access, add, or update certain information on the Site. When you update information, however, we often maintain a copy of the unrevised information in our records.

b. You may request retraction of certain information you may have posted to the Site by sending an e-mail to support@TheMotherhood.com. The Motherhood makes no representations regarding whether and in what timeframe such information may be retracted.

c. You may request deletion of your The Motherhood account by sending an e-mail to support@TheMotherhood.com. The Motherhood makes no representations regarding whether and in what timeframe such account will be deleted.

d. The Motherhood may store a Member's Personal Information indefinitely.

e. Some information may remain in our records after deletion of an account or a retraction of content. This information includes but is not limited to member name, email address and posts to the web site.

f. The Motherhood is not able to retract or delete any of your Personal Information that has already been shared with a third party as permitted in this Privacy Policy.

8. Children's Use of the Site. The Motherhood is not intended for children and is not designed to attract children. The Motherhood does not approve of the use of this Site by children under the age of 13 and does not collect Personal Information from any person we know is a child under the age of 13. If you are over the age of 13 but under the age of 18, you must have the permission and supervision of a parent or guardian to use this Site.

9. Dispute Resolution. Any dispute arising out of your visit to the Site is subject to this Privacy Policy and our Terms of Use Agreement, including limitations on damages, arbitration of disputes, and application of the laws of Commonwealth of Pennsylvania. Any resolution of such dispute shall take place in the courts of Allegheny County, Pennsylvania. By agreeing to this Privacy Policy you hereby irrevocably submit to personal jurisdiction in Allegheny County, Pennsylvania.

10. Third Party Sites. The Site may permit you to link to other websites on the Internet, and other websites may contain links back to the Site. Other websites are not under The Motherhood's control. The privacy and security practices of websites linked to or from the Site are not covered by this Privacy Policy. The Motherhood is not responsible for the privacy or security practices or the content of such other websites.

11. Changes to this Privacy Policy. The Motherhood occasionally may amend this Privacy Policy. Use of information is subject to the Privacy Policy in effect at the time such information is collected. While we may notify you by posting an announcement of any such changes on our Site or via some other reasonable means of notice, The Motherhood encourages you to review this Privacy Policy periodically to keep informed.
